ARTICLE 1- PARTIES

1.2- SERVICE USER

In the framework of this contract, the Service User refers to the person / persons who request to receive online or face-to-face training services from DoctorB Academy by providing membership from the website called “www.doctorbacademy.com” operated by DoctorB Academy. The personal information provided by the Service User while requesting the service will be taken as the basis of the contract (“Service User”).

From now on, Service User and DoctorB Academy will be referred to as the “Parties”.

 

ARTICLE 2- SUBJECT OF THE CONTRACT:

The subject of this Distance Service Contract (hereinafter referred to as the Contract) is the determination of the rights and obligations of the parties regarding the educational services, the scope, form, duration and price of which are determined below, in the areas of which the content and prices are included on the website of “www.doctorbacademy.com” website of DoctorB Academy, in accordance with the Law on the Protection of the Consumer, Distance Contracts Regulation and other relevant legislation provisions.

 

ARTICLE 3- SERVICE INFORMATION:

Information about the service subject to this Agreement; the cost of the service, payment methods are as follows:

 

Service Description: The purpose of DoctorB Academy is to be an educational institution that can learn and teach appropriate knowledge and skills that will contribute to the global development of technology and quality in aesthetic surgery and medical applications. For this purpose, it is to provide training services to the consumers face to face or online in the areas where the content and prices are stated on the “www.doctorbacademy.com” website.

ARTICLE 4 – AUTHORIZED INTERMEDIARY FOR PAYMENT / COLLECTION:

The parties acknowledge that the fee determined for the training service subject to this contract to be provided by DoctorB Academy can be paid by the Service User to the Turkey Is Bank IBAN NO: TR48 0006 4000 0021 2060 3494 65 bank account of DoctorB Academy by transfer. They also acknowledged that this fee can be paid by credit card payment to the TÜRKİYE İŞ BANKASI Online Payment System with the referral to be made on the “www.doctorbacademy.com” website of DoctorB Academy.

 

If the Service User makes the payment by credit card, all requests for personal data will be directed to the bank and as personal data in this direction will not be shared with DoctorB Academy and will be directly transferred to bank.

 

ARTICLE 5- GENERAL PROVISIONS

5.1. Prior to this Agreement, the Service User accepts all kinds of information about the service, including but not limited to information on the basic qualifications, prices, payment method, additional payments, transaction date of the training services provided on the “www.doctorbacademy.com” website. The Service User accepts and declares that he / she has read and understood the information regarding the service specified in the third article of this Agreement and gives the necessary confirmation before this Agreement is concluded.

 

5.2 Service User accepts, declares and undertakes that he / she has confirmed the preliminary information form regarding the service prior to this Agreement.

5.3 The parties acknowledge, declare and undertake that they accept the provisions of the Law on the Protection of Consumers and the Regulation on Distance Contracts, as well as the terms of this Agreement, and that they will act in accordance with these provisions.

5.4 All articles of this Agreement have been read and accepted by DoctorB Academy and the Service User, and this Agreement enters into force on the date it is electronically approved by the Service User.

5.5. When the Service User gives his / her approval to this Agreement via the electronic system, he / she accepts and declares that he / she knows that the Agreement has been established, the payment obligation arises under the Agreement and that he / she will make the payment.

5.6. The Service User accepts and declares that all kinds of personal data will be processed and informed by DoctorB Academy for the execution of the contract within the scope of the Law on the Protection of Personal Data No.6698 and the relevant legislation.

 

ARTICLE – 6 RIGHT OF WITHDRAWAL:

6.1 The Service User has the right of withdraw from this Agreement without any justification within 14 (fourteen) days after the establishment of the contract for service performance. In order for the Service User to exercise his / her right of withdrawal, it is obligatory to notify DoctorB Academy in writing or from the e-mail address stated in the contract, including his express will.

6.2 The parties acknowledged that they cannot exercise their right of withdrawal in accordance with Article 15/1 of the Distance Contracts Regulation:

6.2.1 Goods or services whose prices vary depending on fluctuations in financial markets and are not under the control of DoctorB Academy or the provider,

6.2.2 Services prepared in line with the consumer’s wishes or personal needs,

6.2.3 Services related to accommodation, food and beverage supply and leisure time for entertainment or recreation, which should be done on a specific date or period,

6.2.4 Immediate services in electronic environment or intangible goods delivered immediately to consumers,

6.2.5 Services started with the consent of the consumer before the right of withdrawal expires.

6.3 In the event that the Service User exercises his right of withdrawal, DoctorB Academy will provide the consumer with the total amount received within 14 (fourteen) days from the date of receipt of the withdrawal notification and any document that puts the consumer under debt, except for the costs incurred so far due to the signature of the contract is obliged to return it without any expense.

6.4 In case the service is provided that is not requested by the Service User, DoctorB Academy cannot make any claim against the Service User, without prejudice to the consumption of the service.

 

ARTICLE – 7 NOTICES

The Service User makes all notifications, including the withdrawal notice to be made in accordance with the fourth article, in writing by using the contact information of the DoctorB Academy above. DoctorB Academy makes all notifications regarding this contract to the mobile phone of the Service User. The Service User declares and accepts that he / she approves any promotion or notification to be made via SMS, e-mail, calling, whatsapp and similar digital means.

 

ARTICLE – 8 COMPETENT COURT:

In the disputes that will arise regarding this Agreement, the Consumer Problems Arbitration Committees in the settlement of the Service User are authorized each year up to the value declared by the Ministry of Customs and Trade, and the Consumer Courts are authorized in the disputes above the said value.
